Terms of Service

1. Agreement to these terms

These terms are an agreement between you and MadByteApps covering your use of the CardScout app. By downloading or using CardScout you agree to them. If you do not agree, do not use the app.

Our Privacy Policy forms part of this agreement.

2. Who can use CardScout

You must be at least 13 years old. If you are under 18, you may only use the app with the consent of a parent or guardian, who accepts these terms on your behalf and is responsible for any subscription purchase.

3. What CardScout does

CardScout lets you photograph sports trading cards and receive an AI-generated identification, including player, set, year, condition impression and an estimated value. You can organise cards into collections, sync them across your devices, ask an AI assistant about a card, and take part in a public community feed.

Some features require a Pro subscription. We may add, change or discontinue features at any time.

4. Your account

CardScout works without an account. Creating one is optional and is required only for community features.

Keep your sign-in method secure and tell us if you think someone else has access. You are responsible for activity under your account. One person, one account: do not sell or transfer it, and do not create a new account to get around a suspension.

5. Subscriptions and billing

CardScout Pro unlocks card identification, value estimates, card chat and condition check. The available plans, prices and any free trial are shown in the app before you buy.

We may change prices. Changes never affect a period you have already paid for, and Apple will ask for your consent before charging a higher renewal price. Promotional offers may be limited or withdrawn at any time.

6. Value estimates are not appraisals

CardScout's identifications, condition impressions, value estimates and price charts are produced by an AI model working from a photograph. They are informational estimates. They are not appraisals, authentications, professional grades, insurance valuations, or financial advice.

In particular:

Verify a card independently before you buy, sell, insure, trade or grade it. You are responsible for decisions you make using CardScout, and we are not liable for losses arising from them.

7. No affiliation

MadByteApps and CardScout are independent. We are not affiliated with, endorsed by or connected to any trading card manufacturer, sports league, team, player or grading company, including Topps, Panini, Upper Deck, Fanatics, the NFL, NBA, MLB, NHL, FIFA, PSA, BGS, SGC or CGC.

Card names, set names, team names, player names, logos and card images belong to their respective owners and appear in CardScout only to identify and describe cards.

8. Your content and the community

Your card photos, collections, posts and comments remain yours. You grant us permission to store and display them only so far as we need to run the app: syncing your collection, sending images for identification, and showing your posts to other users. That permission ends when you delete the content. We do not use your content to train AI models and we do not license it to anyone else.

Community content is public. Your username, profile picture, posts, comments and attached images are visible to everyone, including people without an account, and images may stay reachable by direct link after deletion. You confirm you have the rights to whatever you post.

Community rules

Do not post:

Normal card talk is fine, including prices, trades and honest criticism.

Posts pass through an automated content filter, and users can report and block. Automated filtering is imperfect and is not a guarantee. We do not review every post by hand and we are not responsible for content other users publish. We may remove content or restrict any account at our discretion.

9. Acceptable use

You agree not to:

Running AI identification costs us money on every request, so we apply reasonable limits to prevent automated abuse. They are set well above normal use. If one ever gets in your way, email us.

10. Intellectual property

CardScout, including the app, its design, its content and the MadByteApps and CardScout names, belongs to MadByteApps. We grant you a personal, non-transferable licence to use CardScout on Apple devices you own, for your own non-commercial use. All other rights are reserved.

11. Termination

You can leave at any time by deleting your account in Settings › Delete Account or by deleting the app. Deleting your account does not cancel a subscription, which you must cancel through Apple.

We may suspend or end your access, or remove your content, if you break these terms, if your use harms other users or the service, or if the law requires it. Where reasonable, we will tell you why first.

12. Disclaimers and liability

To the fullest extent permitted by law, CardScout is provided "as is", without warranties of any kind. We do not warrant that the app will be uninterrupted or error-free, that card identifications or value estimates will be accurate, or that content posted by other users will be accurate or lawful. CardScout depends on third-party services we do not control, and an outage on their side may interrupt it.

To the fullest extent permitted by law, MadByteApps will not be liable for indirect, incidental or consequential damages, or for loss of profits, data or the value of any card or collection. This includes any loss arising from reliance on an identification, condition impression, value estimate or price chart. Our total liability for all claims is limited to the greater of what you paid us in the 12 months before the claim, or 50 US dollars.

You agree to cover us for any claim arising from content you post, your breach of these terms or your misuse of the app, except where the claim is caused by our own breach or negligence.

Nothing here excludes liability that cannot lawfully be excluded, and if you are a consumer your mandatory statutory rights are unaffected.

13. Changes

We may update these terms as the app or the law changes, and the effective date above reflects the current version. If a change materially affects your rights, we will give notice in the app first. Continuing to use CardScout after that means you accept the updated terms.

14. Governing law

These terms are governed by the laws of the Republic of Turkey, and the courts of the Republic of Turkey have jurisdiction over any dispute. If you are a consumer, this does not remove the protection of mandatory consumer law where you live.

Please email cardscout@madbyteapps.com before starting formal proceedings. Most problems are faster to fix that way.

15. Apple App Store terms

CardScout is distributed through the Apple App Store, so the following also apply. "Apple" means Apple Inc.
